Dear Member,

Thank you so much for becoming a Member with MysticalRoseFavours If, for any reason, you are not completely satisfied with your membership and wish to leave then I am so sorry that you are dissatisfied and I will ensure that you will not need to pay any additional fees if you ever wish to cancel your membership with us.

I, Catherine, Owner and Artist for MysticalRoseFavours, will receive any and all payments given by you and promise to use the money only towards the following:
● Rent & Council Tax Payments for my flat
● Manufacturing Costs for production partners
● Shipping Costs for delivery services
● Website Domain and business email costs

The individual joining our Membership agreement through our website or Kofi, acknowledges and agrees to be bound by the terms and conditions listed:

Article 1 - Membership Agreement

This Membership Agreement is entered into and made effective as soon as you sign up as a member between either of the following parties:

Article 2 - Membership Bound

By Accessing or using any of the membership services, you agree to be bound and abide by this agreement and any amendments. Please read this agreement carefully before considering becoming a Member. If you do not agree to these terms, please immediately cease use of any of the membership services.

Article 3 - Membership Services

The membership services provided by MysticalRoseFavours are as follows:
● Exclusive Discounts for Products, Merchandise and Commission Requests.
● Exclusive Content for free or lowered price compared to non-members.
● Gift Subscriptions for discounts on purchasing products.
● Behind the Scenes and early access for Video projects, Blog posts and our Portfolio and Sketchbook pages

Article 4 - Fees

Members are responsible for the payment of fees to MysticalRoseFavours each month. There are currently four categories of membership choices which come with their own reward and monthly payment system (Refer to Article 1 Membership Agreement). The monthly fees range from:
● £1.00 for Rose Tip Members with a monthly 10% off on gift subscriptions
● £3.00 for Rose Bud Members with a monthly 15% off on gift subscriptions
● £5.00 for Rose Blossom Members with a monthly 20% off on gift subscriptions

Payment will be calculated in Euro Pound form so the price range may change depending on your location and use of currency. The first fee payment is due on the day you sign up as a member and ends the day you cancel your membership without any additional cost. 

Fees may be paid via the following methods:
● Visa
● Paypal
● Mastercard
● American Express
● Google Pay
● Apple Pay

Article 5 - Termination

This membership Agreement shall continue until terminated by either party. Rose Members are free to cancel their membership without the need to pay a fee whenever they request and will lose access to their subscription rewards upon cancelation until they rejoin again as a rose member. However this agreement may also be terminated by us in the event that there is a breach of the terms of this agreement. You will receive a notice email to inform you that you have breached the terms of our membership policy and that you have been banned from our membership rewards. You may try dispute this by replying to the email for us to ask for a reconsideration, but you may be rejected if you are caught violating our membership agreement. (Refer to Articles 6 - 11)

Reasons why I would terminate your membership:
● Misuse or sharing coupons with members or non-members both online and in-person
● Attempting to use or re-use member-only coupon codes when you are not a member. 
​● Sell, resale, cropping, or commercial use of artwork, logos, products or merchandise related to MysticalRoseFavours.
● Share, sell, resale, crop or commercial use of restricted webpages, private blog posts, passwords for private Youtube videos related to MysticalRoseFavours.
● Breaching our art commission requests. (Refer to Article 11 Representation) 

Article 6 - Limited License

Our members acknowledges and agrees that MysticalRoseFavours' name, services, and any logos, designs, text, graphics, software, content, files, materials and any other intellectual property rights, including without limitation, any copyrights, trademarks or other rights arising, are owned by MysticalRoseFavours, and their affiliates, licensors and suppliers. Members expressly agrees not to do anything inconsistent with MysticalRoseFavours ownership of all of the in intellectual property discussed. For any membership services which enable you to use any software, content, equipment, or other physical or non physical materials owned or licensed by us, we grant you a limitation, revocable, non-exclusive, sub-licensable, non-transferable license to access and use the specific membership services, and any related software, content, equipment or other materials FOR YOUR PERSONAL, NON-COMMERCIAL USE ONLY.

Article 7 - Restrictions

You are prohibited from, and expressly agree that you will not:
(i) Circumvent or disable any content protection system or digital rights management technology used with any membership services.
(ii) Decompile, reverse engineer, disassemble or otherwise reduce any membership services to a human-readable form.
(iii) Remove identification, copyright, or other proprietary notices in or on the membership services.
(iv) Access or use any membership services in an unlawful or unauthorised manner, or in a manner that suggests an association with our content, products, services, or brands, unless you have an executed agreement with us that allows for such activity.
(v) Use, alter, copy, modify, store, sell, reproduce, distribute, republish, download, publicly perform, display, post, transmit, create derivative works of, or exploit any membership services or any part thereof, except as expressly authorised in this agreement or as part of the membership services provided to you.
(vi) Introduce a virus or other harmful component, or otherwise tamper with, impair, or damage any membership services or connected networks, or interfere with any person's or entity's use or enjoyment of any of the membership services.
(vii) Access, monitor, or copy any element of the membership services using a robot, spider, scraper, or other automated means or manual processes without our express written permission.
(viii) Sell, resale, or make commercial use of the membership services, unless you have an executed agreement with us that expressly allows such activity.

Article 8 - Third Party Services

Certain membership services may integrate, be integrated into, or be provided in connection with third-party websites, services, content, and/or materials ("Third-Party Services"). We do not control any third-party services. We additionally make no claim or representation regarding the third-party services and accept no responsibility for the quality, content, nature, or reliability of third-party services accessible from our websites, application, software or any element of the membership services. There is no implied affiliation, endorsement, or adoption by the organisation of these third-party services and we shall not be responsible for any content provided on or through these third-party services. You should read the terms of use and legal agreements that apply to these third-party services.

Article 9 - Member Consents

● Member agree to hold MysticalRoseFavours, its owner, affiliations, and representations, harmless from any damage, whether tangible or intangible, that may happen to the member while participating in the membership services.
● Member agrees that MysticalRoseFavours offers its membership program with no guarantee of results of any kind. Member agrees that any results that occur during their membership, whether positive or negative, are the effects of the member's own personal choices.
● Member agrees and verifies that all of the information they have given MysticalRoseFavours and its representatives is accurate, up to date, and without the omission of any requested information.
● Member agrees and verifies that even if they have omitted any necessary personal information, whether knowingly or unknowingly, they will hold MysticalRoseFavours harmless against all liability for any damages that may occur to the member or others because of the member's actions or inactions.
● Member agrees to notify Mystical Rose Favours membership group of any changes or upcoming changes concerning their personal information.

Article 10 - Assumption of Risk

Member agrees and understands that their participation in the membership services may involve risks that may lead to harm if used irresponsibly. 
Members agree that these risks may result not only from their own actions but also from the actions of others. With the knowledge and understanding of theses risks, members choose of their own violation and will, to continue participating in the membership services but may request to opt out at any point if they lose interest or simply cannot keep paying monthly and are allowed to re-enter their membership when they request it, unless they are specifically banned from doing so.

Article 11 - Representation 

Member agrees that they are over the age of 18 and may legally consent to and enter into this agreement as we do request a monthly payment plan.

You are prohibited from, and expressly agree that you will not:
● NOT PROMOTE NUDITY, HOMOPHOBIA, RACISM, VIOLENCE, BULLYING OF ANY KIND, ILLEGAL UNDER-AGE ACTIVITY AND USE OF VULGAR LANGUAGE!
● NOT REQUEST THE ABOVE FEATURES TO APPEAR IN ANY OF OUR ARTWORK - INCLUDING IN YOUR COMMISSION REQUESTS!

We recommend younger individuals who wish to become Members for any reason[s] I humbly ask for you to request your parent, guardian, adult sibling or other adult family member's permission before you sign up as a Member for MysticalRoseFavours. Any adult figure can easily view updates on our Instagram which you can also find on our homepage.
 
Please note that I provide free downloadable jpgs, gift subscriptions and discount codes, and sale updates through emails for members to enjoy. However, if you, as a guardian do not wish to receive any of this then I urge you to contact me to request a restriction to not receive any specific membership reward.

All artwork, posts, memberships, sales and discounts are all created my myself, Catherine, and I will always do my best to ensure that my work is child-friendly. The theme for MysticalRoseFavours consists of colourful flowery artwork and cartoon characters that are cute, innocent and friendly for everyone. My products meet the standard safely regulations, and my jpegs are safe for use on your computer, mobile phone and ipad.
